Returns & Exchanges

All products sold on this website are manufactured to order and as such are not refundable, returnable or exchangeable.  ALL SALES ARE FINAL.  We make every effort to inspect your order before shipping.  However, upon delivery of your order, please carefully inspect your merchandise.  If you receive defective or damaged merchandise, you may contact us at 702-360-6464 or via email at info@jackievontobel.com .  In the event that it is determined that we are responsible for the damage or defect we will be happy to exchange your order for new merchandise identical to the merchandise ordered on your original invoice.  The customer must resume the responsibility of notification to Jackie Von Tobel of defect or damage within seven (7) days of receipt of the order.  Any claims after this date will be considered null and void.    

Products

Fabric & Cut Yardage:    All fabric is sold in full yard increments only with a minimum purchase of one yard.  Volume discounts on retail orders of 50 yards or over are available.  Please contact us for a quote.

All fabric yardage is custom, printed to order and non-returnable or exchangeable for any reason except if the order is damaged upon delivery or there is a significant defect in the fabric beyond the natural fiber variations or color due to the printing process.  Yardage must be inspected carefully for defect before cutting and cannot be replaced if cut.

Pillow Covers:   All pillow covers are custom printed and made to order.  They are non-returnable, non-refundable, or exchangeable for any reason except if the order is damaged upon delivery or there is a significant defect in the pillow fabric or construction, beyond the natural fiber variations or color due to the printing process. 

Pillow Inserts:    All inserts are filled with a blend of 10% goose down and 90 % feathers.  They are covered with a natural cotton down proof fabric. Inserts are non-returnable and non- refundable.

Quality  We reserve the right to alter minor details of the products featured on this site.  Accordingly, we have made every effort to depict the color and texture of each item as accurately as possible. However, individual monitors will vary in color representation.  It is highly recommended of the customer to order samples of products to insure color accuracy. 

Products may differ slightly from those depicted on this site.  Some of our products may show slight differences in color or texture that do not necessarily indicate defectiveness.  Such differences are inherent in the manufacturing of hand made products, so you may expect that there will be minor distinctions that will make your purchases unique. 

Taxes   We will only collect sales tax on purchases and shipping costs on orders shipped within the state of Nevada.

Shipping   We use UPS for shipping on all orders.  Therefore we cannot ship orders to a P.O. Box.  A valid physical mailing address must be provided at the time of your order. 

Fabrics are shipped rolled full width on a cardboard tube with the print side of the fabric facing inwards.  The roll of fabric is double wrapped in heavy duty plastic for shipping.  Fabric orders under 5 yards will be shipped folded in a carton.

Pillows are wrapped in plastic and shipped in cartons.

Warranty   We make every effort to ensure that the merchandise that is purchased on this site is free from errors or defects of any kind.  However, Jackie Von Tobel does not declare to have warranties of any kind.

Forms of Payment  We accept the following credit cards for the payment of your purchase through a secure payment gateway:  Visa, Master Card, American Express.  We do not accept cash, checks, or other forms of payment.

“No Self” Policy   We understand that changes or cancellations may need to be made to your order.  However, we have a “No Self” Policy, in that all of our orders are custom made specifically for your purchase.  Should you feel the need to alter your order in anyway this MUST be done within 24 hours after placing your order via phone to 702-360-6464.  After 24 hours your order will be implied as correct.  It is the customers’ responsibility to cancel an order within 24 hour time period after purchase.  Jackie Von Tobel will not be held accountable if this is not followed and will reserve the right to charge a cancellation fee.

The content, merchandise and services made available to you on this site are provided by Jackie Von Tobel in accordance with the following terms and conditions of use and privacy policy (“Terms and Conditions”). The Terms and Conditions constitute an agreement between you and Jackie Von Tobel in respect of your use of this site; your use of this site is conditioned upon your acceptance of the Terms and Conditions without modification. Your use of this site constitutes your acknowledgement and acceptance of the Terms and Conditions in their entirety.

This site and all of the content made available on it is owned by Jackie Von Tobel or its partners. These are protected from unauthorized use, copying and dissemination by copyright, trademark, publicity and other laws and international treaties. Jackie Von Tobel grants to you a non-exclusive, limited purpose license to access and view this site, and to print selected pages that appear on this site for your own personal reference and non-commercial use, but not to otherwise use the Content in any manner not expressly authorized in these Terms and Conditions. Nothing contained in these Terms and Conditions may be interpreted to grant to you any other license or right to access or use any of the Content without the prior written consent of Jackie Von Tobel or any relevant third party owner of the Content. By using this site and placing orders for merchandise featured on this site, you are representing and warranting that you are over 18 years of age, that all information that you provide to us is true, accurate and complete, and that you have the authority to provide that information and to place those orders.

Please review our shipping and return policies before placing orders on this site. We will not be liable for any loss, damage, cost or expense related to delays in shipment or delivery of merchandise. The risk of loss of, and title to, all merchandise purchased on this site will pass to you upon our delivery of that merchandise to the carrier selected to deliver it.

Jackie Von Tobel will collect sales tax on all purchases of retail merchandise to be shipped to locations within the state of Nevada. Users are responsible for all sales taxes and other taxes, if any, applicable to merchandise shipped to locations outside the state of Nevada. The rate of sales tax applicable to all merchandise shipped to locations within the state of Nevada will be the rate applicable in Nevada at the time of purchase. You and/or the recipient will be solely responsible for any duties or customs charges imposed on all purchases of merchandise shipped to locations outside the United States.

YOU UNDERSTAND AND AGREE THAT YOU ARE USING THIS SITE AT YOUR OWN RISK, AND THAT THIS SITE IS PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE” BASIS. You agree to indemnify and hold harmless Jackie Von Tobel, and its directors, officers, employees, contractors and suppliers (“Indemnified Parties”), from and against any and all claims, demands, actions, proceedings and damages, including without limitation reasonable attorneys’ fees and costs, that may be incurred by any of the Indemnified Parties and that arises from or relates to your use of this site.

These Terms and Conditions will be governed by and construed in accordance with the laws of the State of Nevada. Any dispute arising between us shall be brought before any court located within the State, City and County of Nevada having jurisdiction over such a dispute. By using this site you irrevocably submit to the jurisdiction of the above-mentioned Nevada courts for purposes of resolving any such dispute, and waive any claim or defense of inconvenient forum or lack of personal jurisdiction.

Although Jackie Von Tobel attempts to meet the highest standards of the industry regarding durability and color stabilization of our product, Jackie Von Tobel assumes no responsibility for the numerous conditions to which the fabrics might be exposed. Jackie Von Tobel cannot guarantee against wear, abrasion, and color fading, nor against contact with any liquid, shrinking, pilling, stretching, wrinkling, staining, discoloration, damage by pets, children or pests or the effects or applications of treatment, cleaning, etc. The furnishing of any care or cleaning instructions is not intended nor does it create any warranties, express or implied, on the part of Jackie Von Tobel.

All claims must be filed within seven (7 )  days of receipt of product. Failure to make a claim within this period shall constitute Client’s acceptance of the merchandise. Differences in color and quality within normal commercial tolerances shall not constitute grounds for a claim. Claims for labor charges will not be considered under any circumstances. Merchandise will not be accepted for refund or credit once it has undergone processing such as flame-proofing, water repellant, stain resistance, backing, etc.

Jackie Von Tobel does not provide any guarantees or warranties, express or implied, including any warranty as to merchantability or fitness for a particular purpose, or otherwise, except warranty as to title and the fabric’s fiber content. Jackie Von Tobel’s liability shall be limited to the replacement of any nonconforming fabric or the refund of the purchase price, provided the Client complies with Jackie Von Tobel’s return requirements. In no event shall Jackie Von Tobel be liable for any loss or damage, directly or indirectly, arising from the use of any fabrics or for any special, incidental, consequential or punitive damages arising from breach of warranty or contract, negligence, strict liability in tort or any other legal theory, including, without limitation, injury to person or property, loss of goodwill, profits or revenue, loss or use of merchandise, cost of any substitute merchandise or claims of any party dealing with Client for such damages
